Terms & Conditions of Batela Trading (Pty) Ltd t/a Batela South Africa (“the Supplier”)
By using the Supplier’s website, you/the customer confirm that you have read the terms and conditions regarding the conduct of parties accessing or using the Supplier’s website to trade, set out herein (“the Conditions”), and that the customer agrees to be bound by these Conditions.
Please note that should the customer not agree to the Conditions stated below, the customer may not use the Supplier’s website. The site is managed in South Africa and promotes the sale of various branded products. Purchases made from the site are subject to the terms and conditions of this agreement. By shopping on or browsing this site, the customer acknowledges that it has read, understood, and agrees to be bound by these Conditions and the other policies displayed on the Supplier’s website.

The Supplier’s website may not be reproduced, duplicated, copied, sold, or otherwise exploited for any commercial purpose without the prior written consent of the Supplier.
Disclaimer of Warranties & Limitation of Liability
By visiting the Supplier’s website site on the Internet, the customer agrees that using this service is entirely at its own risk. The site and its contents are provided on an as-is basis and the Supplier makes no representations or warranties of any kind, whether regarding correctness of information, stock levels or otherwise.
The information expressed and displayed on this site should not be regarded as the opinion of the Supplier. Users are encouraged to consult professional advice before taking any course of action related to information displayed on this site.
While the Supplier has put reasonable measures in place, it does not guarantee that the services provided by the site will be uninterrupted or error free, or that the website, its servers, or e-mails sent from the Supplier are free from viruses.
The Supplier, its directors, members, employees and/or suppliers shall not be liable for any loss, damage or expense which may be suffered by the customer resulting from use of the website, ordering product/s online, or wearing the product/s purchased.
By accepting the Conditions the customer indemnifies the Supplier against any loss or damage suffered, including without limitation in respect of any claim or demand by any third party by reason of any act or omission on the customer’s part or that of any family member, agent or representative acting on the customer’s behalf in connection with transaction/s concluded.
The Supplier’s liability whether in contract or delict arising from any breach of any obligation in terms of this Agreement, negligence or otherwise shall not exceed at any time more than the monetary value of the item/s purchased with regards to any dispute.
Applicable law
The Supplier’s website and all communications and transactions concluded using the website, are governed by the laws of the Republic of South Africa.
Invitation to do business
The products which are displayed on the Supplier’s website are seen as an invitation to do business with the Supplier. Transactions are only confirmed when the Supplier has accepted the customer’s transaction and the acceptance is communicated to the customer via email or telephone call.
The price of any products sold by the Supplier shall be relayed to the customer at the time of the order. By visiting the Supplier’s website, the customer agrees that the terms and conditions will be applicable to all further transactions and website visits.
Stock
The Supplier will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, listed products are removed from it. The Supplier will only be liable for delivery of the products when the products are available. When products are no longer available after conclusion of a sale, the Supplier will notify the customer and will be entitled to either select another product or choose to receive a refund of the amount paid.
Electronic communications
When a user visits or emails the Supplier, the customer is consenting to communicating with the Supplier electronically. The Supplier will communicate with the customer by email.
User Information
When purchasing products, the customer is required to supply complete and accurate information about him/her/it and agrees that the information provided to the Supplier is correct. Purchasing from the Supplier is restricted to persons over the age of 18.
Our Rights
The Supplier reserves the right to: 1. Modify or withdraw, temporarily or permanently, the website (or any part of) with or without notice to the customer, and not be liable to the customer or any third party for any loss or damage suffered arising from modification to or withdrawal of the website; and/or 2. Change these Conditions and policies from time to time, and continued use of the website (or any part of) following such change shall be deemed acceptance of such change by the customer. It is the customer’s responsibility to check regularly to determine whether the Conditions have been changed. If the customer does not agree to any change to the Conditions then they must immediately stop using the website. 3. The Supplier will implement reasonable measures to maintain the website. The website is subject to change from time-to-time. The customer will not be eligible for any compensation due to the face that it cannot use any part of the website or because of a failure, suspension or withdrawal of all or part of the website due to circumstances beyond the Supplier’s control.

In an attempt to provide increased value to the users, the Supplier may provide links to other websites or resources. The customer acknowledges and agrees that the Supplier is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable, directly or indirectly, for the privacy practises or the content (including misrepresentative or defamatory content) of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external sites or resources.
Security Policy
- Paygate process all credit card transactions. The details of their function, security measures and standards, and privacy policy, can be found on their website https://www.paygate.co.za/.
- The Merchant does not have access to credit details.
- Paygate continually reviews and enhances its security in line with technological changes.
Monitoring
The Supplier has the right, but not the obligation, to monitor any activity and content associated with the website. The Supplier may investigate any reported violation of these Conditions or complaints and take any action that they deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to the access and/or removing of any materials from the website).
Updating of these Terms and Conditions
The Supplier reserves the right to change, modify, add or remove portions or the whole of these Conditions, or any of the Supplier’s online policies, from time-to-time. Changes to these Conditions will become effective upon such changes being posted to this website. It is the customer’s obligation to periodically check these Conditions on the website for changes or updates. The customer’s continued use of this website following the posting of changes or updates will be considered notice of the customer’s acceptance to abide by and be bound by these Conditions, including such changes or updates.
Consent
The customer understands that all the designs and trademarks are registered to the Supplier. The customer undertakes not to copy/duplicate the trademarks, designs directly or indirectly in any way, and understands the legal implications of failing to abide by this. Should the customer be in violation of this agreement he/she/it understands that he/she/it will be held liable for all legal costs incurred by the Supplier for any legal action deemed necessary against me.
